AHMEDABAD: A city sessions court convicted a youth for raping a minor girl and sentenced him to a seven-year imprisonment on Thursday.
Additional sessions judge A M Dhimani also slapped a penalty of Rs 10,000 on Sushant Chaudhary, and ordered to give Rs 8,000 from the amount to the rape victim.
As per the complaint that was registered on September 24, 2008, in the Odhav police station, Chaudhary and the girl had eloped together and three of Chaudhary's friend had helped them.
The couple was traced in Midnapur district of West Bengal after a week and detained.
Upon being brought back, Chaudhary was arrested on charges of rape, for the girl was just 14 years old.
Trial commenced and public prosecutor Dinesh Sharma examined 14 witnesses, out of whom four government witnesses turned hostile.
The defence lawyer placed an audio CD on record which contained telephonic talks between the girl and the convict to establish that they had an affair and that the girl was not kidnapped.
However, the prosecutor argued that there was no evidentiary value of the audio CD, since there was no expert opinion attached nor was there any spectrography test conducted to prove that the voices contained in the audio file are that of the accused and the victim.
After hearing the case, the court held Chaudhary guilty and punished him with a fine and seven-year jail sentence.
