Rape 'victim' turns hostile in court, refuses to identify accused

A rape "victim", who had accused Harmail Singh, husband of Sunita Chaudhary, a local councillor, of outraging her modesty and recording the act last year, turned hostile and refused to identify the "culprit" in an open court on Monday.
The prosecutrix had, however, recorded her statement against Singh before a judicial magistrate under Section 164 of the Criminal Procedure Code (CrPC). The father of the prosecutrix had supported the case of the prosecution and on October 16 had deposed before the court. He had stated that Singh made obscene MMS of his daughter.
The court of Additional District and Sessions Judge (ADJ) G C Garg on October 15 had framed charges of rape, trespass and criminal intimidation against Singh.
With the U-turn, the "victim" has attracted charge of perjury, a decision which the court will take at the time of final orders. Declaring the girl hostile, the court has deferred the hearing on Singh's bail application for Tuesday.
On May 24 this year, the girl had moved an application seeking impleadment of Singh as co-accused in an ongoing case of rape pending against one Vijay, a resident of Indira Colony.
The girl had deposed that Singh had also raped her and had made a video in the cellphone. An FIR was registered at the Manimajra police station on May 20, 2009.
Singh had been evading appearance despite repeated court summons and warrants. He surrendered finally on October 14. The Punjab and Haryana High Court last month had ordered day-to-day hearing of the case.
